1. Acceptance Of These Terms

These Terms of Service ("Terms") govern your use of hardmoneytruckloans.com (the "Site") and your communications with Hard Money Truck Loans ("Hard Money Truck Loans," "HMTL," "we," "us" or "our"). By using the Site, submitting a form, or calling or texting us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

2. Who We Are And What We Do

Hard Money Truck Loans provides commercial truck and trailer financing to businesses and business owners, including credit challenged buyers, for trucks purchased from licensed dealers. All financing is for business and commercial purposes only. We do not make personal, family or household (consumer) loans, and the Site is not intended for consumer borrowing.

3. Eligibility

You must be at least 18 years old and able to enter a binding contract to use the Site or request financing. If you submit information on behalf of a business, you represent that you are authorized to act for that business.

4. No Offer Or Commitment To Lend

Information on the Site, including program descriptions, down payment percentages, purchase price ranges, examples and educational articles, is provided for general information only. It is not an offer to lend, a commitment to lend, a pre-approval or a guarantee of approval or of any rate or term.

Every request is reviewed individually. Approval, down payment, rate, term and all other conditions are determined only after review of the complete transaction, which may include bank statements, credit information, the truck and the dealer. Any financing is subject to final underwriting and to signed written loan documents, which control over anything stated on the Site or in conversation. Program terms may change without notice.

5. Information You Provide

You agree that all information you submit to us is true, accurate, current and complete, and that you will promptly update it if it changes. Providing false or misleading information may result in denial of financing and may violate law. You authorize us to verify the information you provide, including by contacting the dealer, your bank and other third parties, and, with your separate authorization, by obtaining credit reports.

6. Consent To Calls, Texts And Emails

By submitting a form on the Site or providing your phone number or email address, you agree that Hard Money Truck Loans may contact you by phone call, text message and email at the contact information you provide about your inquiry, application or financing, including by automated means. Message frequency varies. Message and data rates may apply. Consent is not a condition of obtaining financing.

You can opt out of text messages at any time by replying STOP, and you can get help by replying HELP. You can opt out of emails using the unsubscribe instructions in the email or by contacting us. Carriers are not liable for delayed or undelivered messages.

7. Acceptable Use

When using the Site, you agree not to:

• Submit false, fraudulent or another person's information without authorization.
• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to the Site, its servers or any connected systems.
• Interfere with the Site, including by introducing viruses or other harmful code or by overloading the Site with automated requests.
• Copy, scrape, republish or commercially exploit Site content without our written permission, except for normal search engine indexing.

8. Intellectual Property

The Site and its content, including text, graphics, logos, icons, images and the Hard Money Truck Loans name, are owned by or licensed to Hard Money Truck Loans and are protected by intellectual property laws. You may view and print pages for your personal, non-commercial reference. No other rights are granted.

9. Third Party Links And Dealers

The Site may contain links to third party websites. Dealers, sellers and other third parties are independent businesses and are not agents of Hard Money Truck Loans. We do not control and are not responsible for their websites, products, vehicles, warranties or representations. Any purchase of a truck or trailer is between you and the dealer.

10. Disclaimer Of Warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. Educational content is not legal, tax, accounting or financial advice. Consult your own advisors before making financial decisions.

11. Limitation Of Liability

To the fullest extent permitted by law, Hard Money Truck Loans and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of or inability to use the Site or its content, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100). Nothing in these Terms limits rights under your signed financing documents.

12. Indemnification

You agree to defend, indemnify and hold harmless Hard Money Truck Loans and its owners, employees and partners from any claims, losses and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of the Site or any inaccurate information you submit.

13. Governing Law And Disputes

These Terms are governed by the laws of the United States and the state in which Hard Money Truck Loans is organized, without regard to conflict of law rules. Any dispute relating to the Site or these Terms will be resolved in the state or federal courts located in that state, and you consent to their jurisdiction. Disputes relating to a funded transaction are governed by the dispute terms in your signed financing documents.

14. Changes To The Site And These Terms

We may change, suspend or discontinue any part of the Site at any time. We may also update these Terms. The updated Terms will be posted on this page with a new effective date, and continued use of the Site after a change means you accept the updated Terms.

15. Severability And Entire Agreement

If any part of these Terms is found unenforceable, the remaining parts stay in effect. These Terms and our Privacy Policy are the entire agreement between you and us regarding the Site. Signed financing documents govern any financing transaction.
